1. Who this agreement is with
These Terms of Service ("Terms") are an agreement between you and Joshua Gibson ("DoPoint," "we," "us"), governing your use of the DoPoint mobile application and any related services (the "App").
By creating an account or using the App, you agree to these Terms. If you don't agree, don't use the App.
2. Who can use DoPoint
You must be 13 years or older to create an account. If you are under 18, you confirm you have a parent or guardian's permission to use the App.
DoPoint is not directed at children under 13, and we do not knowingly collect data from anyone under 13. If we learn we have, we'll delete it.
3. What DoPoint is — and isn't
DoPoint helps you notice patterns in your eating habits and distinguish genuine hunger from emotional or stress-driven eating, using a forecast built from information you provide and, if you choose to connect one, data from your wearable device.
DoPoint is not:
- A medical device
- A substitute for medical, psychological, dietetic, or professional advice
- A diagnostic tool for any eating disorder or health condition
- A crisis or emergency service
DoPoint's forecasts are informational, not clinical. They are generated from patterns in your own data and are not always accurate. Nothing in the App should be treated as a medical recommendation about whether, when, or how much to eat.
4. Your account
You're responsible for keeping your login credentials secure and for all activity under your account. Tell us immediately if you suspect unauthorized access.
You agree to provide accurate information — your height, weight, and other profile data directly affect what the App shows you, and inaccurate data will produce inaccurate results.
5. Subscriptions
DoPoint offers a free tier and a paid subscription tier ("DoPoint+"), billed monthly or annually.
Billing. Subscriptions are purchased and managed through the Apple App Store or Google Play, and are governed by their respective terms in addition to these. We do not process payment information directly.
Auto-renewal. Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before renewal, through your Apple or Google account settings.
Cancellation. You can cancel any time through the App Store or Play Store. Canceling stops future renewals; it does not refund the current period unless required by law or platform policy.
Price changes. We'll give you notice before any price change takes effect for your next renewal.
Refunds are handled by Apple or Google under their own policies; we don't have the ability to issue refunds directly.
6. Health data and wearables
If you choose to connect a wearable or health platform (e.g., Apple Health, Google Health Connect, Fitbit), you're granting DoPoint permission to read specific data types (such as heart rate, sleep, and activity) for the purpose of generating your forecast. You can revoke this access at any time through your device's settings or the App.
Connecting a wearable is always optional. The App is fully usable with manual tracking alone.

7. Acceptable use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the App's underlying models or source code
- Use automated means (bots, scrapers) to access the App
- Impersonate another person or provide false health data with intent to mislead the service
- Use the App's chat feature to seek medical, legal, or crisis advice it is not equipped to give
8. AI-generated content
DoPoint uses AI to power in-app chat and pattern forecasting. AI-generated responses are not reviewed by a human before you see them, may occasionally be inaccurate, and should not be relied upon as professional advice. See §3.
The chat feature may, for certain health or nutrition questions, reference or link to third-party websites (for example, government or established medical-institution resources) rather than calculate a personalized answer itself. We do not own, operate, control, or verify the ongoing accuracy of any third-party site, and linking to one is not an endorsement of its content, its availability, or how it handles your data once you leave the App. Use of any third-party site is governed entirely by that site's own terms and privacy policy, not this one.
9. Intellectual property
The App, including its design, forecasting methodology, and content, is owned by DoPoint and protected by intellectual property law. You retain ownership of the personal data you input (your logs, journal entries, and profile information); you grant us a license to use it solely to provide and improve the App's functionality for you.
10. Termination
You may delete your account at any time in Settings. We may suspend or terminate your access if you violate these Terms, or if required by law.
Upon deletion, your data is handled as described in our Privacy Policy.
11. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT FORECASTS WILL BE ACCURATE OR THAT THE APP WILL MEET YOUR EXPECTATIONS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) THE APP AND ALL CONTENT, FORECASTS, AND AI-GENERATED RESPONSES ARE PROVIDED WITHOUT WARRANTY OF ANY KIND (SEE §11), AND YOUR USE OF THE APP IS AT YOUR OWN RISK.
(b) IN NO EVENT WILL Joshua Gibson BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(c) OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (i) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).
(d) NOTHING IN THIS SECTION LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
13. Indemnification
You agree to indemnify, defend, and hold harmless Joshua Gibson and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App in violation of these Terms; (b) your violation of any law or the rights of a third party; or (c) content or data you submit through the App.
14. Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
15. Changes to these Terms
We may update these Terms from time to time. We'll notify you of material changes in-app before they take effect. Continued use after changes take effect constitutes acceptance.
